EMpulse Data License

These terms govern access to the EMpulse Street FX Index data ("Data") through the EMpulse API, exports and website by the customer who accepts them ("you"). By creating an invoice, paying for or using a paid key you accept these terms.

1. License

1.1. We grant you a non-exclusive, non-transferable, non-sublicensable license to use the Data for your organisation's internal purposes only: research, analysis, risk management, internal reporting and internal models.

1.2. You may show insubstantial extracts of the Data (individual figures or charts, not series that can be reassembled into a dataset) in internal or client-facing documents, citing "Source: EMpulse".

2. Restrictions

You must not, without a separate written agreement with EMpulse:

• redistribute, publish, sell, resell, rent, sublicense or otherwise make the Data or any substantial part of it available to third parties, whether in original or modified form;
• use the Data to build or feed a competing data product, index or price feed;
• download the Data in bulk or by automated systematic retrieval beyond what your plan allows, or try to bypass quotas and limits (for example, by using several keys);
• remove or alter source attributions, or attempt to remove or neutralise individual differences in the Data (section 4).

3. Personal keys

3.1. Each API key is issued to a named customer (the email address and organisation given at purchase) and is personal. Do not share a key outside your organisation; you are responsible for all use of your key.

3.2. If you suspect your key has leaked, tell us at hello@empulse.ai and we will replace it.

4. Identifiable series

Series delivered to each key may contain insignificant individual differences that identify the key. They do not affect the analytical value of the Data. Data found outside the licensed use can be traced back to the key it was delivered to.

5. Suspension for bulk download

We monitor request patterns. If a key's activity looks like automated bulk download or systematic copying of the dataset, we may freeze the key immediately. A frozen key receives an error with an explanation. Access is restored only after review. Fees for the period of a suspension caused by a breach of these terms are not refunded.

6. Plans, payment and renewal

6.1. Pro is paid in advance in USDT on the TRON network (TRC-20), for 30 days or 365 days. The subscription starts when the payment is confirmed; a renewal is added to the current end date.

6.2. Only the exact invoice amount is credited automatically. Payments over other networks, in other tokens or of other amounts may be lost or require manual handling.

6.3. After the end of a subscription there are 3 days of grace; then the key continues on the free plan.

6.4. Payments are non-refundable except where required by law.

7. Enterprise

Enterprise access (full exports, liquidity data, custom benchmarks, SLA) is provided only under a separate written agreement, which prevails over these terms where they differ.

8. No warranty, liability

8.1. The Data is derived from aggregated market data and public market sources. It is not an official or interbank rate and is not investment advice. It is provided "as is", without warranty of accuracy, completeness or availability.

8.2. To the extent permitted by law, our total liability is limited to the fees you paid for the 12 months before the claim. We are not liable for indirect or consequential losses.

9. Changes and termination

We may update these terms; the version you accepted is recorded. Material changes apply from your next renewal. We may terminate access for a material breach of sections 2-3.
