EMpulse Enterprise Terms
Version 2026-10-25-draft. Draft: subject to approval. These terms apply to Enterprise access requested through the calculator at https://empulse.ai/enterprise and paid by invoice. They extend the EMpulse Data License; where they differ, these terms prevail.
1. Scope
1.1. EMpulse grants the customer named in the invoice ("you") access to the EMpulse Street FX Index data ("Data") with the options chosen in the calculator and listed on the invoice: the currencies, the frequency (daily or hourly), the history period, bulk export, the service level and the number of keys.
1.2. The agreement starts when the invoice is paid and runs for the term stated on the invoice. It renews for the same term when the renewal invoice is paid before the end of the current term; otherwise access moves to the free plan after 3 days of grace.
2. Permitted use
2.1. Internal use across your organisation (all entities under common control), including internal models, pricing, risk, reconciliation and reporting, on as many internal systems as you need.
2.2. Display to your customers: individual figures and charts derived from the Data may be shown to your own customers inside your product or reports, citing "Source: EMpulse", provided the Data itself cannot be extracted as a series from what you show.
2.3. Bulk export (when chosen): full exports through /v1/export and CSV files for the purposes above, stored on
your systems. Exports stay within your organisation.
3. Restrictions
Without a separate written agreement you must not resell, sublicense or redistribute the Data as data; feed it into a public or third-party price index; or share keys outside your organisation. Section 4 of the Data License (identifiable series) applies to every key.
4. Service level
4.1. Standard: the API is operated with the aim of continuous availability; the public status page (https://empulse.ai/status) shows the 90-day history. Data is updated daily; the hourly index at hourly granularity with the daily update.
4.2. SLA option (when chosen): monthly availability of the API of at least 99.9 %, measured by the health checks shown on the status page; a named contact; first response to a reported incident within 4 hours; for each full percentage point below 99.9 % in a month, one day of the term is added at no charge, up to 10 days per month.
5. Fees and payment
5.1. Fees are stated on the invoice in USDT (TRC-20) for the term and are paid in advance. Only the exact invoice amount is credited automatically.
5.2. Fees are non-refundable except where required by law or under section 4.2.
6. Data protection
The data processing addendum at https://empulse.ai/enterprise/dpa is part of this agreement. EMpulse processes only the contact data needed to run the account; the Data itself contains no personal data.
7. Warranty, liability, term
7.1. The Data is derived from aggregated market data and public market sources; it is not an official or interbank rate and is not investment advice. It is provided "as is"; EMpulse does not warrant accuracy, completeness or fitness for a particular purpose.
7.2. Each party's total liability under this agreement is limited to the fees paid for the 12 months before the claim; neither party is liable for indirect or consequential losses.
7.3. Either party may terminate for a material breach not cured within 30 days of notice. EMpulse may suspend keys immediately for a breach of section 3.
8. Governing law and changes
The governing law and the competent courts are those of EMpulse's place of registration, stated on the invoice. Changes to these terms apply from the next renewal; the version you accepted is recorded with the invoice.
